§ 1. General provisions

  1. These terms and conditions govern the provision of copywriting, editing, educational, consultation, technical and support services by Student Support Wioletta Boćkowska, with its registered office at ul. Ogrodowa 16, 05-500 Mysiadło, NIP: 1231529988, email address: info@studentsupport.pl, telephone: +48 515 693 084, hereinafter referred to as the Service Provider.
  2. The terms and conditions apply to services offered through the website studentsupport.pl, email, contact forms, online messaging apps, telephone contact and other agreed Communication Channels.
  3. The terms and conditions are made available to the Customer before work on the service begins, in a way that allows the Customer to read, save and reproduce them in the future.
  4. The Customer must read and accept the terms and conditions before work on the service can begin. By accepting them, the Customer acknowledges their provisions and undertakes to comply with them. Placing an order is equivalent to accepting these terms and conditions.
  5. The Service Provider operates as a lawfully established copywriting business, specialising in preparing, editing, proofreading, developing, formatting, reviewing and organising textual, academic, educational, model, presentation and technical materials.
  6. The services do not constitute legal, tax, medical or psychological advice, or representation of the Customer before a university, supervisor, reviewer, committee, dean's office, administrative authority or other institution.
  7. The Service Provider performs the services with due care, taking into account the professional nature of its business, the scope of the Assignment, the information provided by the Customer and the individually agreed terms of performance.
  8. No provision of these terms and conditions is intended to exclude or restrict the Consumer's rights where this would conflict with mandatory provisions of law.

§ 2. Definitions

For the purposes of these terms and conditions, the following definitions apply:

  1. Service Provider – Student Support Wioletta Boćkowska.
  2. Customer – a natural person, legal person or organisational entity using the Service Provider's services.
  3. Consumer – a natural person concluding a contract with the Service Provider for a purpose not directly related to that person's business or professional activity.
  4. Business Customer – a Customer concluding a contract in connection with their business or professional activity.
  5. Service – any service provided by the Service Provider, including copywriting, preparation of Model Material, proofreading, editing, thesis review, text development, research results analysis and presentation, methodological support, preparation of a questionnaire, bibliography or footnotes, document formatting, preparation of a presentation or another individually agreed service.
  6. Assignment – the individually agreed scope of a service, including the type of work, deadline, fee, payment method, Input Materials, method of performance and form in which the result is delivered.
  7. Input Materials – all information, files, guidelines, topics, sources, data, reports, research results, supervisor's comments, university requirements, bibliographies, questionnaires, documents and other materials provided by the Customer before work on the service begins.
  8. Final Material – the result of the service prepared by the Service Provider, such as a text, document, study, review, comment, table, chart, presentation, bibliography, footnotes, proofread or edited material, model degree thesis or other file delivered to the Customer.
  9. Model Material – material commissioned by the Customer for educational, illustrative, editorial or support purposes, which may provide an example of how to develop a topic, structure a text, compile a bibliography, approach methodology, build an argument, carry out analysis or organise a thesis.
  10. Work – an individually specified result of the Service Provider's work, prepared on the basis of an agreed Assignment, including a text, study, review, edited or proofread material, presentation, bibliography, questionnaire, results analysis or other Final Material.
  11. Communication Channel – any means of contact between the Customer and the Service Provider, including email, a contact form, Messenger, WhatsApp, Instagram, Facebook, SMS, telephone, an online messaging app or another agreed means of distance communication.
  12. Quotation – information provided to the Customer by the Service Provider about the expected fee for performing the service, based on the scope of work, deadline, materials and information supplied by the Customer. A Quotation may constitute an offer to conclude a contract if it contains the essential terms of the Assignment and indicates an intention for the Service Provider to be bound by it.
  13. Acceptance of the Assignment – the Customer's express confirmation of the terms of performance, including by email, Messenger, WhatsApp, SMS, contact form, a reply such as "I accept", "agreed", "OK", "let's go ahead", "please proceed" or "I confirm", payment after receiving the Quotation, or other conduct indicating consent to work on the service beginning.
  14. Documentary Form – a form of making a declaration of intent in which its content is recorded on a medium that allows the content to be read and the person making the declaration to be identified, including an email, SMS, online messaging app message, contact form or other electronic record.

§ 3. Scope of services

  1. The Service Provider offers, in particular, the following services:
    a) copywriting and commissioned text creation,
    b) preparation of Model Materials, including model degree, bachelor's and master's theses,
    c) proofreading and editing,
    d) text revision in relation to the similarity level and the JSA report,
    e) methodological support,
    f) preparation of survey forms, questionnaires, interview guides and other research instruments,
    g) analysing research results and preparing tables, charts, descriptions and conclusions,
    h) preparation, correction and standardisation of bibliographies, footnotes and citations,
    i) document formatting in accordance with the university's, faculty's or supervisor's guidelines,
    j) degree thesis review,
    k) support with thesis structure, outline, contents and the organisation of chapters and subsections,
    l) preparation of multimedia presentations and presentation texts,
    m) other individually agreed textual, editorial, educational, model, technical or support services.
  2. The detailed scope of each service is determined by the individual arrangements between the Service Provider and the Customer.
  3. The information presented on the website is for information purposes and does not constitute an offer within the meaning of the Polish Civil Code, unless expressly stated otherwise.
  4. The contract is concluded once the scope of the service, price, completion deadline and payment method have been agreed and the Customer has accepted the terms and conditions.
  5. The Service Provider may make commencement of work on the service conditional on receipt of the full fee, an advance payment, an earnest-money deposit (zadatek) or another agreed payment.

§ 4. Concluding a distance contract by email, contact form, messaging app or telephone

  1. The contract between the Customer and the Service Provider may be concluded at a distance, including through the website, contact form, email, SMS, Messenger, WhatsApp, Instagram, Facebook, another online messaging app or a telephone conversation.
  2. Under the principle of freedom as to the form of a declaration of intent, a contract may be concluded through any conduct of the parties that sufficiently expresses their intention to conclude it, including electronically. A separate paper document does not need to be signed unless mandatory provisions of law require a specific form for the transaction concerned.
  3. In particular, the contract is concluded when the parties agree at least the essential terms of the Assignment, namely:
    a) the type or scope of the service,
    b) the subject of the Assignment or topic of the material,
    c) the fee or the method of determining it,
    d) the completion deadline, if agreed as an essential term,
    e) the materials or guidelines on which the Service Provider is to base the service.
  4. The terms of the Assignment may be accepted, in particular, by a message stating: "I accept", "agreed", "OK", "let's go ahead", "please proceed", "I confirm", "I am placing an order", "you can start" or by another reply which, in the context of the previous arrangements, signifies the Customer's consent to the service being performed.
  5. Payment of the fee, an advance payment, an earnest-money deposit or another agreed amount after the Customer receives a Quotation, Assignment summary or information about the terms of performance may also constitute acceptance of those terms.
  6. If, after receiving a summary of the Assignment terms, the Customer provides materials for the work, makes a payment, confirms commencement of work or otherwise unambiguously indicates that they want the service performed, the Customer is deemed to have accepted the agreed Assignment terms, unless the circumstances indicate otherwise.
  7. The Quotation, Assignment summary message, messages exchanged by the parties, payment confirmations, screenshots, conversation history, emails, SMS and contact form messages may serve as evidence of the arrangements, acceptance of the terms and conclusion of the contract.
  8. Where arrangements are made by telephone, the Service Provider may send the Customer an Assignment summary by email, SMS or messaging app. If the Service Provider proposes that a Consumer conclude a contract by telephone, it confirms the proposed contract on paper or another durable medium. The Consumer's declaration concluding the contract is then effective if recorded on paper or another durable medium after receipt of that confirmation. In other cases, confirming the summary, making a payment or instructing work to begin signifies acceptance of the terms it contains, subject to mandatory provisions of law.
  9. The absence of a handwritten signature does not affect the validity of a distance contract if the law does not require a specific form for the transaction concerned as a condition of validity.
  10. If the law requires a specific form for a particular transaction, such as written form as a condition of validity, arrangements made solely by messaging app, email, SMS or telephone may not be sufficient to produce legal effects requiring that form. This applies in particular to the transfer of economic rights in copyright, which requires written form as a condition of validity.
  11. For Student Support services, the standard effect of concluding the contract is the Service Provider's obligation to perform the agreed service or Work and the Customer's obligation to pay the agreed fee. The transfer of economic rights in copyright, the grant of an exclusive licence or another specific disposition of copyright requires a separate, express agreement and compliance with the form required by law.
  12. By accepting the Assignment terms by email, messaging app, contact form, SMS, telephone or payment, the Customer confirms that they have read the scope of the service, fee, deadline and terms and conditions.
  13. In the event of a discrepancy between these terms and conditions and the parties' individual arrangements, the individual arrangements take precedence, provided they have been expressly confirmed by the Service Provider and do not breach mandatory provisions of law.

§ 5. Legal nature of the services as a contract for a specific work (umowa o dzieło)

  1. The services involve preparing an individually specified result, including a text, study, proofread or edited material, review, bibliography, footnotes, results analysis, questionnaire, presentation or other Final Material.
  2. To the extent that the Assignment involves preparing a specified result, the contract between the Customer and the Service Provider is a contract for a specific work (umowa o dzieło) within the meaning of Article 627 of the Polish Civil Code.
  3. This means that the Service Provider undertakes to complete a specified Work and the Customer undertakes to pay the agreed fee.
  4. The Customer acknowledges that the materials ordered are not ready-made, repeatable products, but are prepared individually on the basis of the topic, guidelines, materials, needs and arrangements provided.
  5. The individual nature of the Assignment means that, once work begins, the Service Provider undertakes intellectual, analytical, conceptual, editorial or technical work whose result is tailored to the particular Customer.

§ 6. Model materials and the Customer's academic responsibility

  1. Model Materials prepared by the Service Provider are educational, illustrative, editorial and supportive in nature.
  2. A model degree thesis, model bachelor's thesis, model master's thesis or other Model Material may illustrate how to develop a topic, structure chapters, select sources, build an argument and approach methodology, as well as how to organise a bibliography, footnotes, tables, results and conclusions.
  3. The Customer may use Model Material as an example, educational aid, point of reference, structural model or supporting material for independent work.
  4. Model Material is not intended to be submitted directly as the Customer's own work where this would breach university regulations, principles of academic integrity, copyright or other applicable law.
  5. The Customer bears full responsibility for how the Final Material is used, including any use in dealings with a university, supervisor, committee, reviewer, dean's office or other institution.
  6. The Service Provider does not guarantee a particular grade, a pass, supervisor approval, a positive review, acceptance of a thesis by a university, a successful thesis defence, a particular result in a plagiarism detection system or acceptance of a document by any institution.
  7. The Service Provider is not responsible for decisions of a supervisor, reviewer, committee, university, JSA system, dean's office or other entities over which it has no influence.
  8. The Customer undertakes to use the Service Provider's services in accordance with the law, university regulations, academic ethics and principles of research integrity.

§ 7. The Customer's obligations concerning materials, data and guidelines

  1. The Customer must provide the Service Provider with all necessary materials, which must be correct, complete, up to date and consistent with the actual requirements for carrying out the Assignment.
  2. The materials referred to in paragraph 1 include, in particular, the topic, scope of work, university guidelines, supervisor's comments, thesis outline, sources, research results, JSA report, questionnaire, numerical data, source files, technical requirements, citation style, completion deadline and other information needed to perform the service.
  3. Materials, guidelines, topics, supervisor's comments, files, data, research results, JSA reports, links and other information may be provided to the Service Provider by email, Messenger, WhatsApp, SMS, an online drive or another agreed Communication Channel.
  4. The Customer is responsible for ensuring that the materials provided are accurate, up to date, complete, suitable and consistent with the actual requirements for the Assignment.
  5. The Customer is responsible for ensuring that materials sent through the chosen Communication Channel are complete, up to date, appropriate, legible and readable by the Service Provider.
  6. Before sending materials, the Customer must check that they are appropriate, up to date, complete, legible and consistent with the actual requirements of the university, supervisor or lecturer, or other requirements specified for the Assignment.
  7. The Service Provider performs the service on the basis of materials actually received from the Customer before work begins, unless the parties expressly agree that additional files, data or guidelines must be supplied.
  8. If the Customer sends a photograph, screenshot, document extract, link, incomplete guidelines, an unreadable file or partial information through a messaging app, the Service Provider performs the service solely on the basis of materials actually received and readable, unless the parties have expressly agreed otherwise.
  9. Sending incorrect, incomplete, outdated, inappropriate or unreadable materials, or materials that do not meet the actual requirements, is not grounds for requesting a free revision, a refund of the fee or a price reduction if the Service Provider performed the service in accordance with the materials and information supplied by the Customer.
  10. If the Customer provides the wrong file, incorrect guidelines, outdated supervisor's comments, incomplete data, incorrect research results, the wrong topic, the wrong document version, an outdated report, incomplete sources or other materials that do not meet the Customer's actual needs, the Customer bears the consequences.
  11. If, after work begins or is completed, the Customer provides new guidelines, corrected data, a different file, different supervisor's comments, new sources, a changed topic, a new concept, a more complete document version or information not supplied previously, this may be treated as a change to or extension of the Assignment requiring an additional Quotation.
  12. A change to materials, guidelines, topic, scope, thesis concept, source files or data after work begins is not a revision within the original Assignment if it requires additional work, a new analysis, restructuring of the material or preparation of new sections.
  13. The Customer declares that they have the right to provide the Service Provider with the materials, files, data and content needed to perform the service and that providing them does not infringe third-party rights.
  14. The Customer undertakes not to provide content that is unlawful, offensive or infringes personal rights, copyright, legally protected secrets or third-party rights.
  15. The Service Provider may refuse or discontinue an Assignment if it has reasonable grounds to suspect that the materials supplied by the Customer are unlawful, infringe third-party rights or that the service would be used in a way contrary to the law, university regulations or principles of academic integrity.
  16. If work is discontinued for the reasons referred to in paragraph 15, settlement takes account of the scope of work completed up to that point, unless mandatory provisions of law provide otherwise.

§ 8. Quotations, payment and sales documents

  1. Each Assignment is priced individually, depending on the scope of work, length of the material, level of difficulty, completion deadline, quality of the Input Materials and type of service.
  2. The Service Provider may communicate the Quotation to the Customer by email, SMS, Messenger, WhatsApp, Instagram, Facebook, contact form, telephone or another agreed Communication Channel.
  3. The Quotation applies only to the scope agreed before work begins. If, after receiving the Quotation, the Customer changes the scope of the service, sends additional materials, changes the topic, deadline or requirements, or provides new guidelines, the Service Provider may issue a new Quotation.
  4. The Customer may accept the Quotation by an express confirmation message, including "I accept", "agreed", "OK", "let's go ahead", "please proceed", "I confirm" or "I am placing an order", as well as by making a payment after receiving the Quotation or by other conduct unambiguously indicating an intention for work on the service to begin.
  5. An enquiry about price, timing or feasibility alone does not constitute conclusion of a contract if the parties have not agreed the essential terms of the Assignment or the Customer has not accepted the Quotation provided.
  6. The period for completion starts once all the following conditions have been met:
    a) the scope of the Assignment has been agreed,
    b) the terms and conditions have been accepted,
    c) complete and correct materials have been provided,
    d) the Quotation has been accepted,
    e) the agreed payment, advance payment or earnest-money deposit has been received, unless the parties have agreed otherwise.
  7. If payment is not made by the agreed deadline, the Service Provider is not obliged to begin the Assignment, unless the parties have expressly agreed otherwise.
  8. Payment may be made, in particular, by:
    a) bank transfer,
    b) BLIK,
    c) another individually agreed method.
  9. The Service Provider issues a sales document. Individual customers receive a consumer invoice, while businesses receive an invoice compliant with applicable law, including a structured KSeF invoice where required by law.

§ 9. Earnest-money deposits, advance payments and booking a time slot

  1. The parties may agree that all or part of the payment constitutes an advance payment, an earnest-money deposit or a fee for booking a time slot.
  2. If the parties expressly agree that the amount paid, or part of it, is an earnest-money deposit (zadatek) within the meaning of Article 394 of the Polish Civil Code, the legal effects of an earnest-money deposit provided for in that Code apply.
  3. In particular, if the contract is not performed for reasons attributable to the Customer, the Service Provider may retain the earnest-money deposit received in accordance with the law.
  4. If the contract is not performed for reasons attributable to the Service Provider, the Customer may exercise the rights provided by law.
  5. If the parties do not expressly specify that an amount is an earnest-money deposit, it is treated as an advance payment or a payment towards the fee.
  6. Booking a time slot means that the Service Provider reserves working time, the availability of the person carrying out the work and capacity for the Customer's specific Assignment.
  7. If the Customer cancels the Assignment after a time slot has been booked, preparations have begun or work has started, settlement is made in accordance with § 11 of these terms and conditions.

§ 10. Completion deadlines

  1. The completion deadline is agreed individually for each Assignment.
  2. The completion deadline may change if:
    a) the Customer does not provide complete materials,
    b) the Customer provides incorrect or outdated materials,
    c) the Customer changes the scope of the Assignment,
    d) the Customer sends new guidelines or sources,
    e) the Customer delays replies needed to continue the work,
    f) circumstances beyond the Service Provider's control arise,
    g) additional work not covered by the original Quotation becomes necessary.
  3. If a delay results from the Customer's act or omission, including late provision of materials, failure to reply, sending the wrong files or changing guidelines, the Service Provider is not liable for the postponement of the completion deadline.
  4. Express services are carried out only by individual agreement and may be priced separately.

§ 11. Withdrawal from the contract, cancellation and settlement of the fee

  1. The services are individual in nature and are performed on the basis of detailed arrangements with the Customer, including the topic, scope, guidelines, source materials, university requirements, expected type of work and completion deadline.
  2. For services involving text preparation, editing, proofreading, analysis and presentation of research results, Model Material preparation, review, formatting, preparation of a bibliography, footnotes, presentation or another individually specified result, the contract is a contract for a specific work (umowa o dzieło) within the meaning of Article 627 of the Polish Civil Code.
  3. The contract may also be concluded at a distance, including by email, contact form, Messenger, WhatsApp, SMS, telephone or another Communication Channel, if the parties have agreed the essential terms of the Assignment and the Customer has accepted the Quotation or instructed work to begin.
  4. The Customer acknowledges that the materials ordered are prepared individually, based on the information, topic, guidelines and needs they have provided.
  5. If a Customer who is a Consumer requests that work on the service begin before 14 days have elapsed from conclusion of the contract, they should make an express declaration requesting that performance begin before the withdrawal period expires and acknowledge the consequences of work on the service beginning.
  6. Where a paid service is fully performed with the Consumer's express prior consent, and the Consumer was informed before performance began that they would lose the right to withdraw after performance and acknowledged this, the Consumer has no right to withdraw to the extent provided by Article 38(1)(1) of the Polish Consumer Rights Act.
  7. If the Customer cancels after work on the Assignment has begun, the amount paid is not automatically refundable.
  8. Settlement following cancellation takes account of the stage reached, the nature of the order, time spent on it, tasks performed, materials prepared, the time slot reserved, costs incurred by the Service Provider and the scope of the Work completed up to cancellation.
  9. Until the Work is completed, the Customer may withdraw from the contract under Article 644 of the Polish Civil Code, with an obligation to pay the agreed fee. The Customer may deduct only the amount the Service Provider actually saved as a result of not completing the Work.
  10. Given the nature of copywriting, editorial and academic services, the Service Provider's main input is working time, analysis of materials, concept development, source selection, preparation of the structure, editing, proofreading and intellectual work. In many cases, once work has begun, the Service Provider incurs no significant material costs that could be deducted as savings.
  11. If, at the time of cancellation, the Work has already been completed in full or to a substantial extent, the Service Provider has the right to retain the fee corresponding to the work performed and, if the service has been fully performed, the entire agreed fee.
  12. A change of mind, no further need to use the material, a change of thesis concept, topic or supervisor, new university guidelines, failure to provide the correct materials or provision of incorrect guidelines does not, in itself, entitle the Customer to an automatic refund for work already begun or performed.
  13. The provisions of this section do not restrict the Consumer's rights under mandatory provisions of law. For Consumers, each settlement takes account of applicable law, the nature of the service, the stage of completion and the actual scope of work.

§ 12. Right to withdraw from a distance contract

  1. The Consumer has a statutory right to withdraw from a distance contract within 14 days, unless statutory exceptions to the right of withdrawal apply.
  2. The Consumer may send a declaration of withdrawal electronically to: info@studentsupport.pl.
  3. If the Consumer requests that work on the service begin before 14 days have elapsed from conclusion of the contract and then withdraws before the service is fully performed, they may be required to pay for the service supplied up to withdrawal, in proportion to the scope of work completed.
  4. The Consumer has no right to withdraw from the contract in the cases provided by applicable law, including where:
    a) the Service Provider has fully performed the service with the Consumer's express prior consent, and the Consumer was informed before work began that they would lose the right to withdraw once performance was completed and acknowledged this;
    b) if the subject of the particular contract is non-prefabricated goods made to the Consumer's specifications or to meet their individual needs, and Article 38(1)(3) of the Polish Consumer Rights Act applies. Customisation of a service or digital content alone is not grounds for applying this exception;
    c) if the particular contract concerns paid supply of digital content not supplied on a tangible medium and all the conditions in Article 38(1)(13) of the Polish Consumer Rights Act are met: supply began with the Consumer's express prior consent, the Consumer was informed before supply began that the right to withdraw would be lost after performance, the Consumer acknowledged this, and the Service Provider supplied the legally required confirmation of the contract. Delivery of material as a file does not in itself determine whether this exception applies.
  5. If the Consumer requests that a paid service begin before 14 days have elapsed from conclusion of a distance contract, an express declaration containing that request and acknowledgement of the loss of the right to withdraw once the service is fully performed is required before performance begins, in accordance with the Polish Consumer Rights Act. The declaration may read as follows: "I request that work on the service begin before 14 days have elapsed from conclusion of the contract. I acknowledge that, once the Service Provider has fully performed the service, I will lose the right to withdraw from the contract to the extent provided by applicable law."
  6. The provisions of this section also apply, as appropriate, to a natural person concluding a contract directly related to their business activity where the contract's content shows that it is not of a professional nature for that person, to the extent provided by applicable law.

§ 13. Delivery of the Final Material

  1. The Final Material is delivered to the Customer electronically, including by email, a file link, messaging app or another agreed method.
  2. The Final Material may be delivered in DOCX, PDF, PPTX, XLSX or another agreed format.
  3. The Service Provider is not responsible for an inability to open a file resulting from the Customer's lack of suitable software, an outdated system, technical problems with the Customer's device or email limitations.
  4. The Customer should inform the Service Provider without delay if a file has not been delivered or cannot be opened for technical reasons.
  5. If the Customer modifies the material themselves, the Service Provider is not responsible for the consequences of those changes, including technical, linguistic, substantive, formal or source-related errors arising after delivery of the Final Material.

§ 14. Revisions to the completed service

  1. After the service is completed, the Customer may request revisions to the material prepared by the Service Provider, but only within the scope of the previously agreed Assignment and on the basis of materials supplied before work began.
  2. A revision means correcting or refining an existing section, including its style, clarity, sentence construction, paragraph coherence, compliance with the guidelines provided or precision of content.
  3. A revision request should be specific and substantive. The Customer should identify the section that needs revision and explain why.
  4. A revision does not include extending the original scope of the order.
  5. In particular, a revision does not include:
    a) writing an additional subsection,
    b) adding a new issue,
    c) discussing an additional theory,
    d) changing the topic,
    e) changing the thesis concept,
    f) developing a new section not covered by the order,
    g) working with new sources that were not supplied before the work began,
    h) adapting the material to new guidelines supplied after the service was completed,
    i) adapting the material to supervisor's comments supplied after completion, if those comments go beyond the original arrangements,
    j) a change resulting from the Customer supplying the wrong file, topic or data, or outdated guidelines.
  6. If, after the service is completed, the Customer supplies new university requirements, new supervisor's comments, corrected data, a new topic, additional sources or an amended file, or if the materials supplied earlier prove to be incorrect, this is treated as a change to or extension of the original Assignment and may require an additional Quotation.
  7. The Service Provider does not make revisions based solely on the Customer's subjective impression if the Customer does not identify a specific problem, departure from the arrangements, breach of the guidelines provided or substantively justified concern.
  8. Revisions cannot be used to add new content without limit or repeatedly change the assumptions of the Assignment.
  9. Each revision request is assessed individually. If a comment falls within the original scope of the service and arises from materials provided before work began, the material may be corrected. If it requires work with new data, new guidelines, new material, a changed concept or an extended scope, it is treated as an additional service.
  10. Revision requests must be made within 7 calendar days of delivery of the Final Material, unless the parties have agreed otherwise. This provision does not restrict the Consumer's rights under mandatory law.

§ 15. Complaints

  1. The Customer has the right to submit a complaint about the service performed.
  2. Complaints should be submitted electronically to: info@studentsupport.pl.
  3. A complaint should include:
    a) details allowing the Customer to be identified,
    b) a description of the Assignment,
    c) identification of the element being complained about,
    d) a detailed description of the concerns,
    e) the requested resolution.
  4. The Service Provider examines a complaint within 14 days of receipt. For a Customer who is not a Consumer, this period may be extended if the nature of the matter requires additional information from the Customer. For a Consumer complaint, unless separate statutory provisions provide otherwise, the Service Provider replies within 14 days of receipt, on paper or another durable medium. Obtaining additional information does not extend this statutory period. Failure to reply within that period means the complaint is deemed accepted under Article 7a of the Polish Consumer Rights Act.
  5. If a complaint is incomplete, the Service Provider may ask the Customer to supplement it.
  6. A complaint cannot concern circumstances resulting from incorrect, incomplete, outdated or inappropriate materials supplied by the Customer if the Service Provider performed the service in accordance with the information received.
  7. A complaint cannot be used to extend the original scope of the Assignment, add new content, change the thesis concept or obtain a new service without an additional Quotation.
  8. The complaints provisions of these terms and conditions do not restrict the Consumer's rights under mandatory provisions of law.

§ 16. Confidentiality and no contact with the university

  1. The Service Provider does not disclose information about the Assignment to a university, supervisor, reviewer, committee, dean's office or other third parties, unless required by mandatory provisions of law or expressly authorised by the Customer.
  2. Materials supplied by the Customer are used solely to carry out the Assignment, handle payments, settlements and complaints, defend against any claims and comply with legal obligations.
  3. The Service Provider treats information about the Assignment as confidential. This includes, in particular, the thesis topic, documents, contact details, file contents, supervisor's comments, research results, JSA reports and other materials supplied by the Customer.
  4. The Service Provider may use the assistance of collaborators, subcontractors, accountants, IT support or legal support where necessary to carry out the Assignment, settle the service or protect the Service Provider's rights. Those persons are required to maintain confidentiality.
  5. The Service Provider does not collect data unnecessary for performing the service. The scope of data processed is limited to data necessary for contact, carrying out the Assignment, issuing a sales document, handling payments and complaints, and meeting legal obligations.
  6. The Service Provider may be required to disclose data to the competent public authorities where such an obligation arises under applicable law.

§ 17. Personal data

  1. The controller of the Customer's personal data is Student Support Wioletta Boćkowska, ul. Ogrodowa 16, 05-500 Mysiadło, NIP: 1231529988, email: info@studentsupport.pl.
  2. The Customer's personal data are processed, in particular, for the purposes of:
    a) handling an enquiry,
    b) preparing a Quotation,
    c) concluding and performing the contract,
    d) contact about the Assignment,
    e) settling the service and issuing an invoice,
    f) handling complaints,
    g) pursuing or defending against claims,
    h) complying with the Service Provider's legal obligations.
  3. Providing data is voluntary but may be necessary to perform the service.
  4. Data may be disclosed to entities providing support to the Service Provider, including providers of email, hosting, accounting, payment systems, legal or IT services, solely to the extent necessary to achieve these purposes.
  5. Data are not disclosed to a university, supervisor or other third parties for the purpose of informing them about the Assignment.
  6. The Customer has rights under data protection law, including the right of access, rectification, restriction of processing, erasure in the cases provided by law, objection and the right to lodge a complaint with the President of the Polish Personal Data Protection Office.
  7. The controller's information obligations arise, among other provisions, from Articles 13 and 14 of the GDPR, as also indicated by the Polish Personal Data Protection Office (UODO) in its information materials.
  8. Detailed rules on personal data processing may be set out in a separate Privacy Policy available on the Service Provider's website.

§ 18. Copyright and use of materials

  1. Materials prepared by the Service Provider may constitute a work within the meaning of copyright law.
  2. Upon full payment of the fee, the Customer obtains the right to use the Final Material for their own educational, editorial, informational, organisational or internal purposes, in accordance with the purpose of the Assignment.
  3. Unless the parties agree otherwise in a separate contract, the Service Provider grants the Customer a non-exclusive licence to use the Final Material to the extent necessary for the purpose for which it was prepared.
  4. Arrangements made by email, Messenger, WhatsApp, SMS, telephone or another messaging app may effectively conclude a contract to perform a service or Work, but do not replace the written form required for the transfer of economic rights in copyright where that form is required by law.
  5. The transfer of economic rights in copyright requires a separate, express agreement between the parties and compliance with the form required by applicable law, including written form or electronic form bearing a qualified electronic signature, where such form is permissible and effective for the transaction concerned. Issuing an invoice, sending an email, messaging app message or SMS, or making a payment does not in itself transfer economic rights in copyright, unless the legally required form is also observed.
  6. If the parties do not enter into a separate, legally effective agreement transferring economic rights in copyright, the Customer receives a non-exclusive licence to use the Final Material to the extent necessary for the purpose for which it was prepared, in accordance with paragraphs 2-3 of this section.
  7. Any exclusive licence requires a separate, express agreement and compliance with the form required by law.
  8. The Customer may not resell, distribute, publish or share materials prepared by the Service Provider as the Customer's own commercial services without the Service Provider's separate consent.
  9. The Customer undertakes not to use materials prepared by the Service Provider in a manner contrary to the law, accepted standards of conduct, university regulations or principles of academic integrity.

§ 19. Liability of the Service Provider

  1. The Service Provider is liable for proper performance of the service within the limits of applicable law, the scope agreed with the Customer and the materials supplied by the Customer.
  2. The Service Provider is not liable for consequences arising from:
    a) the Customer supplying incorrect, incomplete, outdated or inappropriate materials,
    b) failure to provide important guidelines before work begins,
    c) changes to the university's, supervisor's or Customer's requirements after work begins,
    d) use of the Final Material contrary to its intended purpose,
    e) decisions of a supervisor, reviewer, committee, university, JSA system or other institution,
    f) the Customer's acts or omissions after receiving the Final Material,
    g) changes made independently by the Customer to the Final Material,
    h) the Customer's use of the material contrary to the law or university regulations,
    i) errors resulting from data, sources, research results or guidelines supplied by the Customer.
  3. The Service Provider does not guarantee any particular external outcome, including a grade, a pass, acceptance of a thesis, supervisor approval, a JSA result, a positive review, a successful defence or a university decision.
  4. The Service Provider's liability to a Customer who is not a Consumer is limited to the fee paid for the Assignment concerned, unless the damage was caused intentionally.
  5. No provision of these terms and conditions excludes or limits the Service Provider's liability to the extent that this would be prohibited by mandatory provisions of law.

§ 20. Refusal to carry out or discontinuation of a service

  1. The Service Provider may refuse or discontinue an Assignment if:
    a) the Customer does not accept the terms and conditions,
    b) the Customer does not make the required payment,
    c) the Customer does not provide the materials needed for the work,
    d) the Customer supplies content that is unlawful or infringes third-party rights,
    e) the Customer expects a service contrary to the law, university regulations or principles of academic integrity,
    f) the Customer behaves in an offensive or aggressive manner, infringes personal rights or obstructs cooperation,
    g) performing the service would require acts contrary to the law or professional ethics.
  2. If work is discontinued for reasons attributable to the Customer, the parties settle the account taking into consideration the scope of work completed up to that point.
  3. If work is discontinued for reasons beyond the Customer's control, the Service Provider informs the Customer of the situation and proposes a solution, including a revised deadline, partial settlement or a refund of the appropriate part of the payment.

§ 21. Communication with the Customer and recording arrangements

  1. The primary means of contact between the Customer and the Service Provider is distance communication, including email, a contact form, Messenger, WhatsApp, Instagram, Facebook, SMS, telephone or another agreed Communication Channel.
  2. Arrangements concerning the scope of the service, price, deadline, materials, revisions, complaints, payments and terms of performance may be made through the indicated Communication Channels.
  3. The Customer must provide a correct email address, telephone number or other means of contact that allows the Assignment to be carried out.
  4. The Customer is responsible for the accuracy of their contact details and for receiving messages concerning the Assignment.
  5. The Service Provider is not responsible for delays resulting from the Customer's failure to reply, incorrect contact details, a full email inbox, technical problems on the Customer's side, failure to receive messages, lack of access to a messaging app or restrictions imposed by the Customer's account privacy settings.
  6. For evidential, settlement and complaints purposes and to protect the rights of the Service Provider and the Customer, the parties may retain correspondence concerning the Assignment, including emails, SMS, messaging app messages, payment confirmations, screenshots and summaries of arrangements.
  7. The Customer acknowledges that messages sent by email, SMS, Messenger, WhatsApp, Instagram, Facebook or another messaging app may constitute recorded declarations by the parties concerning conclusion of the contract, the scope of the Assignment, the Quotation, acceptance of the terms, revisions, complaints or other arrangements.
  8. If the Customer uses a third-party messaging service, such as Messenger, WhatsApp, Instagram or Facebook, that provider's terms and privacy policies may also apply. The Service Provider is not responsible for outages, restrictions, blocks, lost messages or technical problems affecting the external messaging service.

§ 21a. Rules for using the Student Support chat

  1. The Service Provider identified in these terms and conditions provides a free chat service for communicating with its team about the services offered and handling enquiries. The team handles conversations through the Student Support panel or mobile app.
  2. Using the chat requires Internet access, an up-to-date browser supporting JavaScript and functioning session mechanisms necessary to maintain the conversation.
  3. Before sending the first message, the User receives free access to the terms and conditions and information about the effects of sending a message. The terms and conditions are made available in accordance with Article 8 of the Polish Act on the Provision of Services by Electronic Means. A link to the Privacy Policy is also available.
  4. Sending the first message, after the information indicated above has been made available, constitutes acceptance of these terms and conditions for use of the chat, acknowledgement of their provisions and an undertaking to comply with them. The contract for the free chat service is concluded when the system receives that message.
  5. By sending a message, the User requests communication and replies concerning the matter raised. This does not constitute consent to unrelated marketing or an order for a paid service. The terms of a paid Assignment must be agreed separately.
  6. Providing unlawful content, infringing other persons' rights, sending spam and deliberately disrupting the chat are prohibited. In the event of a breach, the Service Provider may end the conversation or restrict access to the chat to an extent and for a period proportionate to the breach. The User may challenge a block by contacting info@studentsupport.pl.
  7. A chat session is maintained for up to 7 days from its creation. The User may end the conversation and clear the session earlier by selecting the "Close and clear session" button, which appears in the chat window once the conversation has begun, and confirming the action. This removes access to the conversation from that browser but does not delete the history retained by the Service Provider. An Agent may end the conversation earlier; an Agent closing it does not in itself remove the session from the browser. Ending use of the chat is free and does not terminate any separate contract for a paid Assignment.
  8. Complaints about the chat may be submitted to info@studentsupport.pl or in writing to the Service Provider's address given in these terms and conditions, describing the problem and providing contact details for a reply. The Service Provider replies within 14 days of receiving the complaint, on paper or another durable medium, including email. Article 7a of the Polish Consumer Rights Act applies to a consumer complaint, including its consequences of failing to reply, where that provision is applicable.
  9. Information about personal data processing is provided in the Privacy Policy available on the website. Acceptance of these terms and conditions does not replace separate consent where required by law. These provisions do not restrict the User's statutory rights, in particular consumer rights.

§ 22. Provisions concerning Business Customers

  1. In dealings with Business Customers, the parties may individually agree different terms for performance of the service, payment, licensing, liability, deadlines and complaints.
  2. For Business Customers, the Service Provider is not liable for lost profits, indirect damage, decisions of the Customer's business partners or the business consequences of using the material, unless mandatory provisions of law provide otherwise.
  3. Any disputes with Business Customers will be resolved by the court with jurisdiction over the registered office of the Service Provider in accordance with the law, unless the parties conclude a separate, legally effective agreement on this matter.

§ 23. Final provisions

  1. These terms and conditions take effect on the date they are published on the Service Provider's website.
  2. The Service Provider may amend these terms and conditions for important reasons, including changes to the law, scope of services, payment methods, the Service Provider's details or the organisation of service delivery.
  3. Assignments begun before an amendment to these terms and conditions are governed by the terms and conditions in force when the contract was concluded, unless the amendment results from mandatory provisions of law or benefits the Customer.
  4. Matters not covered by these terms and conditions are governed by Polish law, including the Civil Code, the Consumer Rights Act, the Act on the Provision of Services by Electronic Means, data protection law and copyright law.
  5. If any provision of these terms and conditions is found to be invalid, ineffective or inapplicable, this does not affect the validity of the remaining provisions. The relevant provisions of law apply in place of the invalid provision.
  6. These terms and conditions should be interpreted consistently with applicable law, in particular the Consumer's rights.
